FAMILY VISA

Australian Family Visas – Partner, Parent & Child

Applying for a family visa can be complex, time-consuming, and highly scrutinised.

Partner Visas – Spouse, De Facto & Fiance

 

Australia offers several partner visa pathways, but each comes with strict eligibility requirements and extensive documentation.

To apply, your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen aged 18 or over.

Your options include:

  • Spouse Visa – if you are legally married

  • Prospective Marriage (Fiance) Visa – if you plan to marry in Australia

  • De Facto Visa – if you are in a genuine relationship without being married

Partner visa applications are heavily assessed, and insufficient evidence is a common reason for refusal.

Partner Visa (820/801)

If you are onshore, Visa Subclass 820 visa would be of suitability. To be eligible, you need to be  in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. The visa allows you to live and work in Australia while awaiting for a permanent (801) visa decision.

Prospective Marriage Visa (300)

If you are offshore and engaged to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, you can apply for visa subclass 300 which allows you to legally enter Australia to marry your fiancé. Upon marriage, you are eligible to apply for a subclass 820/801 Partner visa.

Partner Visa (309/100)

If you are offshore and in a de facto relationship with or married to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, applying for visa subclass 309/100 allows you to legally enter Australia to be with your partner and permits you to live, study, work, and travel without any limitations.

PARENT VISA STREAM

There are various types of Parent Visas applicable on their locations.

The Applicant must have an eligible child who is a settled Australian citizen, Permanent resident or Eligible New Zealand citizen, meet the balance-of-family test, have an Assurance of Support and not have already applied for or hold a Sponsored Parent (Temporary) (subclass 870) visa when applying for this visa.

For Parents applying outside Australia, there are the following visas:

Australian Parent Visas (Offshore Applicants)

Australia offers several visa options for parents applying from outside Australia to join their children who are settled Australian citizens, permanent residents, or eligible New Zealand citizens.

Parent visas are highly regulated, with strict eligibility criteria, significant costs, and long processing timeframes. Choosing the right pathway is essential.

Parent Visa (Subclass 103)

This is a permanent visa allowing parents to live in Australia indefinitely.

However, this visa is subject to very long processing times, often extending over many years due to limited annual places.

Contributory Parent (Temporary) Visa (Subclass 173)

This is a temporary visa valid for up to 2 years.

It is typically used as a first step toward permanent residency under the Contributory Parent pathway.

  • Allows parents to stay in Australia temporarily

  • Can transition to the permanent Subclass 143 visa

  • Enables staged payment of visa costs

Current processing times are often several years and may vary depending on application volume and government allocations.

Contributory Parent Visa (Subclass 143)

This is a permanent visa allowing parents to live in Australia indefinitely.

  • Can be applied for directly, or

  • After holding a Subclass 173 visa

While significantly faster than the Subclass 103 visa, this option involves higher government charges.

Applications can be lodged onshore or offshore, depending on eligibility.

Subclass 804
Permanent visa for parents aged 67 or over who are already in Australia.

🟦 Contributory Parent

Subclass 143
Permanent visa available to eligible parents applying either onshore or offshore.

Best for: Faster permanent outcome
Important: Higher government fees apply

🟦 Contributory Aged Parent (Temporary)

Subclass 884
Temporary visa for parents aged 67 or over who are in Australia.

Best for: Staged pathway to permanent residency
Important: Must transition to Subclass 864

🟦 Contributory Aged Parent

Subclass 864
Permanent visa for aged parents in Australia.

  • Can be applied for directly, or

  • After holding Subclass 884

Best for: Faster permanent pathway (compared to 804)
Important: Higher costs involved

🔍 Key Requirement — Balance of Family Test

Most applicants must meet the Balance of Family Test.

You may qualify if:

  • at least half of your children live permanently in Australia, or

  • more of your children live in Australia than in any other single country

This is a strict requirement and must be carefully assessed before applying.

  • meet health and character requirements

  • satisfy Assurance of Support requirements

[Inference] Parent visa places are limited each migration program year, resulting in long queues — especially for non-contributory visas.
