🎓 Australia Student Visa 

Australia’s Student visa (Subclass 500) allows international students to undertake full-time study in registered courses, including English language programs (ELICOS), vocational education, university degrees, and postgraduate research.

The visa generally allows you to:

  • stay in Australia for the duration of your course

  • travel in and out of Australia

  • work limited hours during study periods

However, the student visa system in 2026 is significantly more complex and strictly regulated than in previous years.

⚖️Current Legislative Framework 

Student visas are governed by:

  • Migration Act 1958 (Cth)

  • Migration Regulations 1994 (Cth)

  • Migration Amendment (Subclass 500 Visas) Regulations 2024

  • Ministerial Directions issued under s 499 of the Act

A key operational policy is:

Ministerial Direction 115 (MD115)

  • Commenced: 14 November 2025

  • Replaced: Ministerial Direction 111

  • Applies to: offshore student visa processing (2026 intake)

MD115 introduces a priority-based processing system linked to education providers and national planning levels, rather than a simple “first-in, first-served” system.

👉 This means:

  • Not all applications are treated equally

  • Processing speed depends on provider behaviour, allocation, and risk profile

  • Some applications are processed faster, others slower — even if lodged at the same time

⚠️ The Genuine Student (GS) Requirement 

Since 23 March 2024, the law replaced the old GTE requirement with the:

Genuine Student (GS) Requirement

Under this requirement, applicants must show they are genuinely coming to Australia to study.

The Department assesses:

  • your personal circumstances

  • your immigration history

  • your compliance with previous visas

  • the relevance of your course

  • your future career benefits

  • any other relevant risk factors

👉 Importantly:

The law no longer focuses on whether you will leave Australia.
Instead, it focuses on whether your primary purpose is genuinely educational.

[Inference] This is a stricter and more holistic test — officers assess your entire profile, not just your written statement.

📉 Why Student Visas Are Harder 

The Australian Government has tightened integrity settings across the student visa program.

Key changes include:

1. Stronger scrutiny under GS test

  • Generic or templated statements are often refused

  • Course must be logical and career-relevant

2. Higher financial capacity

3. Increased English requirements  

4. CoE requirement (onshore applicants)

  • You must hold a Confirmation of Enrolment (CoE) to lodge

5. Processing priority system (MD115)

  • Applications linked to provider risk + national planning levels

 

🧠 Why the Genuine Student Requirement Is Difficult

The GS requirement is not just a document — it is a legal assessment of credibility.

Applications are commonly refused where there is:

  • ❌ course not aligned with past education or work

  • ❌ repeated study at same/lower level

  • ❌ unclear career outcomes

  • ❌ weak financial evidence

  • ❌ inconsistent immigration history

  • ❌ high-risk nationality profile without proper explanation

Even strong applicants can be refused if their case is not strategically presented.

Student visas are no longer “easy” or automatic.

There is no official cap, but the Government now controls numbers through:
